This is insufficient. It does not allow for the sale or transfer of games that have no concrete and separable instantiation.
Even in these times I can buy a game, download it, and play it, all without ever receiving a disc or box.
I do, however, receive an invoice, which represents my ownership of - but is not a copy of - the game.
Under law (mine; your mileage may vary according to state or nation) I have the right of resale. But due to the maker's implementation (no box and/or game tied to my account) no means to execute that right.
I suggest:
"10. Gamers shall have the right to sell or transfer their right to a game to another person, for no more than they paid. Where a game is tied to a player's account, the account system shall provide a reliable mechanism for transfer."
The phrase "for no more than they paid" is towards preventing MMO-style account farming. Its merit may be debatable.
The phrase "reliable mechanism" is towards preventing "but I emailed Acme Support to send you the game!" scenarios.
